TradePath Terms and Conditions

You must be at least 18 years old and have legal capacity to enter into this agreement. TradePath is available to individual retail and prop-firm traders using accounts and information they are authorized to access. If you act for an organization or another person, you must have the necessary authority and comply with any separately agreed terms. Availability is subject to applicable law and supported provider and payment regions.

Provide accurate account information, protect your sign-in credentials, and contact support@tradepath.ai if you suspect unauthorized access. Do not share personal credentials or bypass eligibility or access restrictions. Your responsibility for account security does not excuse a security failure attributable to TradePath.

TradePath provides trading journals, broker connections, analytics, AI chat and insights, and Session Buddy recording and replay on supported macOS and Windows systems. Features, storage allowances, and other limits are described in your plan and checkout. You are responsible for a compatible device, internet connection, and any third-party accounts needed to use a feature.

We may maintain, improve, or change the service, subject to applicable law and our commitments for paid access. We will provide notice of material changes where required. Changes do not authorize undisclosed recording or new uses of your content. Features expressly marked beta may be incomplete or unreliable; beta status does not remove mandatory rights or obligations for paid services.

TradePath supplies software for journaling, review, and analysis. It is not a broker or investment adviser and does not provide individualized investment recommendations, execute trades, or place, modify, or cancel broker orders. AI features provide analysis and insights. You remain responsible for your trading decisions and compliance with broker and prop-firm rules.

Trading involves substantial risk, including loss of capital. AI responses, calculations, imports, transcripts, and other outputs can be inaccurate, incomplete, or delayed. Verify important information against official broker records. TradePath is not a guaranteed trading record, a loss-prevention system, or your sole source for tax, regulatory, or prop-firm reporting. No particular result, profit, or improvement is guaranteed.

Use the service lawfully and only with accounts and content you are authorized to use. Do not access another user’s data, impersonate others, upload malicious software, interfere with the service, evade access or recording controls, or use the service to infringe another person’s rights. These restrictions do not prohibit conduct protected by law or security testing we expressly authorize.

Do not use Session Buddy for covert surveillance or unlawful recording. Respect obligations concerning other people, employers, brokers, trading platforms, and licensed market data. You are responsible for obtaining the rights, notices, and permissions required for content you record or submit. This does not transfer TradePath’s own legal or privacy obligations to you.

Before your first recording, you accept a separate recording and AI-processing notice. Session Buddy records one selected window or display and optional microphone audio. Screen capture can include private messages, notifications, and unrelated information. Do not assume automatic redaction. It does not directly capture system audio, webcam footage, or keystroke logs, although text you type may appear on screen.

You can disable the microphone while continuing screen capture. Pause temporarily suspends both screen recording and microphone capture. Stop ends both. Operating system permissions apply in addition to in-app choices. Your authorization does not provide consent on behalf of another person.

Recordings are uploaded for replay, with enabled microphone audio retained in the video. Audio is transcribed using Whisper on TradePath-managed RunPod infrastructure. TradePath does not extract trading information from the recorded screen. Together AI processes relevant text and trading records for AI features; audio and video files are not sent to Together AI. Further details appear in the Privacy Policy and recording agreement.

“Content” includes information you enter, connect, upload, or record, such as trading records, notes, images, video, audio, transcripts, and chat messages. You retain your rights in your Content. To the extent you have authority, you grant TradePath a non-exclusive, royalty-free license to host, copy, transmit, process, and display it as reasonably necessary to provide requested features through the providers described in the Privacy Policy.

This permission does not authorize public advertising use of your private content, model training, or unrelated product improvement. TradePath does not train or fine-tune AI models on customer content and does not permit Together AI to use submitted customer content for model training. There is currently no feature for other users, mentors, or affiliates to browse or share your private content.

Authorized developers and support staff may access relevant content when necessary for support, troubleshooting, security, or maintenance. If you request an improvement that requires review or testing of private content, we ask for separate permission in a support conversation. Testing copies are deleted when the review finishes or you withdraw permission. You can withdraw by replying in the conversation or emailing support@tradepath.ai. Declining an optional review does not reduce your purchased features. General suggestions do not authorize use of private content as testimonials.

Processing permission ends when the relevant content is deleted, except for processing necessary for a lawful, disclosed retention purpose. A software update or general improvement clause does not expand recording or optional review permissions.

Your checkout identifies the plan, price, currency, applicable taxes, billing interval, and material limits before you authorize payment. Prices and capacity are those displayed for the offer you purchase. Stripe processes payments. You authorize charges for the selected subscription and its renewals as disclosed at checkout.

Payment is collected upfront for the selected billing cycle. Monthly subscriptions renew monthly and annual subscriptions renew annually unless cancelled before renewal. Annual plans are charged as a single annual payment, not monthly installments. A displayed monthly equivalent does not change the annual billing commitment.

Changes to renewal prices or billing terms apply prospectively, with notice and consent where required by law. We do not increase the price for a cycle already paid through an amendment to these Terms. Any separately selected plan change and its charge must be disclosed before authorization.

You may cancel future renewal by emailing support@tradepath.ai from your registered account email or through any subscription cancellation control made available in your account or payment portal. Email requests are assessed by when we receive them, not when staff later process them. A timely request stops the next renewal.

Ordinary cancellation leaves paid access available until the end of the period already paid. Cancellation alone does not request a refund. Deleting a broker connection, stopping a recording, or uninstalling an app does not cancel the subscription. If you delete your entire TradePath account while subscribed, contact support to ensure renewal is cancelled; an account deletion request is not permission for continued billing.

If payment fails, we may request updated payment details, retry payment where permitted, and restrict paid features after the paid entitlement ends. Retries must not override a valid cancellation. Retained data does not entitle you to continued unpaid use. Contact support promptly about an incorrect or unauthorized charge.

For your first subscription purchase made from October 9 through November 9, 2026, inclusive, you may request a full refund within seven days of purchase. This offer applies to all subscription plans, including monthly and annual plans. Payment is collected upfront; the offer replaces the free trial during the launch promotion.

To request a refund, email support@tradepath.ai from your registered account email within seven days of completing the purchase. Include enough information to identify it. Eligibility depends on when you submit the request, not when our team responds. A qualifying request entitles you to a full refund of the initial subscription payment.

Once we issue the refund, the subscription is cancelled and paid access ends immediately, with no further renewals for that subscription. This does not automatically delete your account or stored content. Purchases made on November 9 receive the full seven-day request period, even when it extends beyond the promotion’s end. The offer does not cover renewal charges.

Outside the launch offer or another express offer, subscription payments are non-refundable except where applicable law requires otherwise. Cancelling, not using the service, or changing your mind does not create a right to a prorated refund or credit for an unused portion of a billing cycle. Future promotions apply according to their disclosed terms; these Terms do not promise an ongoing free trial.

Nothing in these Terms limits statutory withdrawal or cancellation rights, remedies for defective or misdescribed services, billing-error corrections, unauthorized-charge protections, or other rights that cannot lawfully be excluded. You do not give up a valid payment dispute by accepting these Terms. Starting access does not by itself waive mandatory withdrawal rights. Where applicable law gives greater protection than our seven-day offer, that law applies.

Changes operate prospectively. Any earlier refund commitment applicable to a purchase remains available under its original terms. Contact support@tradepath.ai to exercise a refund or withdrawal right; any other method permitted by law remains available.

Current integrations include Tradovate, cTrader, TopstepX, and NinjaTrader. The connection flow directs you to the broker’s login page for authorization. Connecting permits retrieval of available trading history and ongoing synchronization within the permissions granted. Broker and platform terms apply separately.

Deleting a broker connection stops syncing, removes or revokes the stored connection authorization, and deletes previously imported trades for that connection. Third-party outages, permission changes, or data errors may affect features. This does not remove TradePath’s own responsibilities or remedies required by law.

The Privacy Policy explains collection, processing, providers, international access, retention, and privacy rights. Recording authorization and permission for optional improvement reviews are separate from acceptance of these Terms. Acceptance does not supply blanket consent to personal-data processing.

Cancellation, a refund, or the end of paid access does not automatically delete saved content. Content remains until you delete it or request deletion under the Privacy Policy. You can delete your entire account in the app, which deletes active service content. You can also delete individual recordings and their transcripts and analyses or data for connected trading accounts. Individual AI conversation deletion is not currently available. Data exports require a request to support.

Billing records, support correspondence, security logs, and consent or acceptance records may remain after account deletion as described in the Privacy Policy. Independent provider records or copies you download may remain separately. Deleting content, cancelling billing, withdrawing review permission, and uninstalling the app have different effects. Renewing payment does not restore content already deleted.

We may proportionately restrict or terminate access for a material breach, a security threat, non-payment after paid access ends, or a legal requirement. Where lawful and practical, we will explain the reason and provide an opportunity to resolve the issue or request review through support. Restrictions do not authorize withholding refunds or other remedies required by law or our commitments.

Termination does not remove rights or obligations already accrued. Provisions concerning intellectual property, lawful payments, necessary retained records, and applicable dispute and liability terms continue to the extent relevant. They do not extend optional permission after withdrawal or authorize undisclosed retention.

TradePath and its licensors retain their rights in the software and original platform materials. While you have authorized access, we grant you a limited, non-exclusive license to use the service for permitted journaling and trading review, including individual prop-firm trading. You may not resell the service, share credentials, operate a competing hosted copy, or copy or modify protected materials without authorization, except where applicable law permits. This license grants no rights in another party’s market data or content.

Subject to applicable mandatory rights and express commitments, the service is provided as available. We do not guarantee uninterrupted operation or error-free AI outputs, recording, imports, or calculations. Maintenance, third-party issues, and events beyond our reasonable control may interrupt service. These limitations do not excuse our own duties, override paid-service descriptions, or remove remedies required by law.

To the extent permitted by applicable law, TradePath’s total liability for claims arising from or relating to the service is limited to the fees you paid TradePath for the service during the 12 months before the event giving rise to the claim. To the same extent, TradePath is not liable for indirect or consequential losses, lost profits, or trading losses.

These limits do not apply where liability cannot lawfully be excluded or limited, including mandatory consumer remedies, fraud, intentional misconduct, gross negligence where non-excludable, and other protected liabilities. They do not reduce non-waivable privacy rights or statutory compensation rights. If a limitation is unenforceable in your jurisdiction, it applies only to the extent the law permits.

To the extent lawful, you are responsible for reasonable losses and legal expenses arising from a third-party claim caused by your unlawful use, material breach of your content or recording obligations, or submission of content without necessary rights. Responsibility is limited to the portion caused by you. It does not shift TradePath’s or its providers’ negligence, security failures, unlawful processing, or non-transferable penalties to you.

We will give reasonably prompt notice, allow a reasonable opportunity to participate in the defense, cooperate appropriately, and mitigate losses. A settlement imposing admissions, non-monetary obligations, or a payment obligation on you requires your written consent, not unreasonably withheld. There will be no duplicate recovery for the same claim under these Terms and the recording agreement.

These Terms are governed by Idaho law, without regard to conflict-of-law rules, subject to mandatory consumer protections. Unless applicable law provides otherwise, disputes are subject to the state or federal courts located in Ada County, Idaho. This choice does not deprive consumers of non-waivable protections or rights to bring proceedings in another forum available under applicable law.

Contact support@tradepath.ai to raise a concern. Informal contact is not a condition for urgent relief, a statutory complaint, or access to a regulator. These Terms do not require binding arbitration or impose a class-action waiver.

We communicate material changes through an in-app notice and any additional notice required by law. Changes apply prospectively. Where fresh acceptance or consent is required, we obtain it before the relevant change takes effect. Installing an update does not authorize new capture or optional uses of content. Acceptance through an identified checkbox or button records your electronic agreement.

Any assignment or transfer of the service or contracts must respect applicable law, existing customer rights, and privacy commitments. You may not transfer your account or credentials without authorization. If a provision cannot lawfully apply, the remaining provisions apply to the extent permitted. Failure to enforce a provision once does not waive future enforcement.

Mandatory law takes precedence. Specific purchase or promotional terms govern the offer they describe. The separate recording agreement governs recording-specific matters, and specific optional-review permission governs that review; neither authorizes processing beyond the permission given. The Privacy Policy describes data practices. No document overrides non-waivable consumer or privacy rights.
