Session Recording and AI Processing Agreement

You must be at least 18 and have legal capacity to enter into this agreement. Before your first recording, you must separately accept this agreement. We retain the acceptance timestamp and agreement version. By accepting and starting a session, you authorize the capture and processing described here for the source and microphone settings you select.

Accepting the general Terms or granting operating-system permissions alone does not authorize a recording. Review your source and microphone settings before each session. You can decline recording and continue using unrelated journal features included in your plan.

Screen recording captures one window or one display you select. Visible content may include unrelated applications, notifications, private messages, credentials, and other confidential information. Capture is not automatically restricted to trading content. Close or hide anything you do not want recorded.

Microphone recording is optional. When enabled, it captures sound picked up by your microphone, which may include nearby voices or sound from speakers. Session Buddy does not directly capture system audio, webcam video, or keystroke logs. Text you type can still appear in the screen recording.

Pause temporarily suspends both screen recording and microphone capture. Stop ends both screen and microphone capture. You may disable the microphone and continue recording the selected window or display.

Recordings are uploaded to Google Cloud infrastructure in the United States for storage and replay. Enabled microphone audio remains in the stored video. TradePath does not extract trading information from the recorded screen or send the video to an AI model for screen analysis.

Audio is transcribed using Whisper on TradePath-managed servers hosted by RunPod in the United States. Temporary audio used for transcription is deleted after processing. Transcripts and relevant trading records and journal notes are sent to Together AI in the United States for analysis using a DeepSeek model hosted by Together AI. AI chat also uses the messages you submit in that conversation. Audio and video files are not sent to Together AI, and these AI requests are not sent directly to DeepSeek or Google Gemini.

Local recording copies are removed after successful upload. If an upload fails, the app retries it and removes the local copy after the retry process. Do not rely on the local recording copy as a backup. Stopping a recording does not itself delete it or cancel processing of content already captured.

You must have the rights, notices, permissions, and consents required for the people, communications, accounts, and content you record. This covers uploading, storing, transcribing, and analyzing the content as well as making the recording. Your acceptance does not supply another person’s consent. Recording laws vary, and consent from everyone involved may be required.

Do not record private conversations, calls, workplace activity, shared devices, or third-party materials without the necessary authority. Employer obligations, broker and platform rules, trading-room subscriptions, intellectual-property rights, and market-data licenses may impose restrictions. This agreement grants no rights in another person’s content or software.

Use a specific window where practical, close unrelated content, and stop recording if lawful capture cannot continue. Do not use Session Buddy for covert surveillance, unlawful interception, or bypassing permission controls. A recording indicator on your screen does not notify everyone whose information may be captured.

You retain your rights in your recordings and other submitted content. To the extent you have authority, you grant TradePath a non-exclusive, royalty-free permission to copy, transmit, host, transcode, transcribe, and analyze that content and make it available to you as needed to provide the requested features through the disclosed providers. This permission is subject to the Privacy Policy, your valid choices, and applicable law.

TradePath does not train or fine-tune AI models on customer content and does not permit Together AI to use submitted customer content for model training. This agreement does not authorize public advertising, testimonials, or unrelated product-improvement use of private content.

Authorized developers and support staff, including staff in Serbia, may access relevant content when necessary for support, troubleshooting, security, or maintenance. If a feature request or improvement requires review or testing of your private content, we ask for separate permission in a support conversation. There is no automatic enrollment in a testing or human-review program. Declining this optional use does not reduce your purchased features.

You can withdraw optional review permission in the support conversation or by emailing support@tradepath.ai. Separate testing copies are deleted when the review finishes or permission is withdrawn. Withdrawal does not itself delete the original recording stored in your account.

Stored recordings remain until you delete them or request deletion. Cancellation, a refund, failed payment, or the end of paid access does not trigger automatic deletion. Retention does not provide continued access to unpaid features.

You can delete individual recordings in the app, including their associated transcripts and analyses, or delete your entire TradePath account. Deletion removes the relevant active service content. Individual AI chat deletion is not currently available; stored chat conversations are removed through account deletion. Contact support for an export or help with a deletion request.

Billing records, support correspondence, security logs, and consent or acceptance records may remain as described in the Privacy Policy. Provider retention is subject to the applicable provider arrangements and law; this agreement does not promise immediate deletion from every provider system. Copies you download or store elsewhere must be removed separately.

To withdraw permission for future recording, stop the session and do not start another recording; you may also revoke operating-system permissions. Stopping, logging out, or uninstalling does not delete uploaded content or cancel a subscription. Subscription cancellation and refunds follow the Terms and Conditions.

Recordings, imports, transcripts, and AI analysis may contain errors, omissions, or delays. Verify important results against official broker records. Session Buddy provides analysis and insights; it does not execute, modify, or cancel trades. It is not a guaranteed transaction record, loss-prevention control, or sole source for tax, regulatory, or prop-firm reporting. Trading decisions remain yours, and no profit or particular result is promised.

To the extent permitted by law, you indemnify TradePath for reasonable losses and legal expenses arising from a third-party claim to the extent caused by your material breach of the responsibilities in Section 4, unlawful recording, or submission of content without necessary rights. This does not cover losses caused by TradePath’s or its providers’ negligence, security failures, contractual breach, unlawful conduct, or processing beyond lawful authorization, or penalties that cannot legally be transferred.

TradePath will give reasonably prompt notice, cooperate reasonably, provide an opportunity to participate in the defense, and mitigate losses. A settlement imposing admissions, non-monetary duties, or a payment obligation on you requires your written consent, not unreasonably withheld. Delayed notice reduces your responsibility only to the extent it materially prejudices your defense. There is no duplicate recovery under this agreement and the Terms.

Nothing here transfers TradePath’s own non-transferable obligations to you or excludes rights or liabilities that cannot lawfully be limited. This agreement creates no separate liability cap, arbitration requirement, or class-action waiver. The Terms govern general liability and disputes, subject to mandatory rights. This agreement controls conflicting general provisions on recording scope, permitted session-content use, and recording-related indemnity. Separate permission controls optional reviews.

Material changes are communicated through an in-app notice and any additional notice required by law. Changes apply prospectively, with fresh acceptance where required. Updates do not authorize undisclosed capture or retroactively expand permission for earlier recordings.

We may proportionately restrict affected recording, upload, or processing for suspected unlawful use, material breach, a security threat, or legal necessity. Where lawful and practical, we explain the reason and how to request review. Restrictions do not expand permitted content uses or remove mandatory refunds or privacy remedies.

If you accidentally record unauthorized content, stop capture, delete the affected recording or contact support, and do not distribute it. People whose information was recorded can report concerns without a TradePath account. Do not email full recordings or credentials unless support has arranged a secure transfer.
